Terms and Conditions of Service Company Name: Curbside Trashcan Service LLC This is an agreement ("Agreement") between you ("Customer") and [Curbside Trashcan Service LLC] ("Company," "we," or "us"). Before using our curbside trashcan service, please carefully read these Terms and Conditions of Service, our Privacy Policy, Recurring Payment Terms, and other applicable policies posted on our website or provided directly to you. By enrolling in and using our service, you agree to these terms. If you do not accept these terms, you may not use the service.
1. Scope of Services 1.1 The Company provides curbside trashcan services, which include moving your trash and/or recycling bins to the curb on the day before the collection days and returning them to your designated storage location after pickup.1.2 This service is offered as a flat monthly subscription, which covers weekly visits for 1 trash bin and 1 recycling bin (2 service visits per week, 8 visits per month). Additional bins may incur extra charges.1.3 The service does not include bin cleaning, waste disposal, or missed collection resolution.
2. Access to Property 2.1 By subscribing, you authorize Curbside Trashcan Service LLC and its helpers (employees or contracted personnel) to access your property for the sole purpose of performing the service. You confirm that you have the legal right to grant such access.2.2 You are responsible for providing clear access to the trash bins on scheduled service days, including but not limited to: Gate codes, lock combinations, or security verification Pets being relocated from storage/bin areas Ensuring bins are not blocked by vehicles or obstructions.2.3 If the Company cannot access your bins for any reason, the service will not be performed that week, and no credit or refund will be provided.
3. Service Limitations 3.1 The Company will make every effort to follow your designated trash collection schedule. However, the service may be disrupted due to events outside our control, such as: Severe weather conditions
Holidays or municipal collection changes Natural disasters or emergencies3.2 The Company will notify you of anticipated disruptions where possible but reserves the right to reschedule or skip service as necessary.
4. Payment Terms 4.1 Monthly Subscription Fee: Service is billed at a flat monthly rate of [$49.99] plus applicable taxes. Payment is due in advance of the month of service.4.2 Recurring Billing: By enrolling, you agree to recurring automatic payments charged to your selected payment method on a monthly basis unless the service is canceled.4.3 Changes to Fees: The Company reserves the right to modify pricing with 30 days' notice. If you do not agree to the price change, you may cancel the service before the next billing cycle.4.4 Taxes: All applicable taxes will be added to the service fee.
5. Cancellations and Refunds 5.1 To cancel the service, you must provide written notice at least 30 days prior to your next billing cycle. Cancellation requests can be submitted to info@curbsidetrashcanservice.com or through our website. 5.2 No refunds will be issued for partial months or unused services. 5.3 For accounts with volume pricing (e.g., multiple properties), cancellations affecting 50% or more of the properties require 90 days' advanced written notice.
6. Customer Responsibilities 6.1 You must ensure that bins are placed in their designated storage area and accessible for pickup on service days.6.2 You are responsible for maintaining safe conditions on your property, including secure gates, fences, and pathways.6.3 Pets: You must ensure that pets are contained or relocated during service times.6.4 Vehicles: We are not responsible for bins being knocked over by vehicles after placement at the curb.
7. Liability and Disclaimer 7.1 Curbside Trashcan Service LLC is not liable for: Damage to bins due to normal wear and tear, misuse, or acts of nature. Property damage caused by circumstances outside our control, including vandalism or accidents. Delays or missed municipal trash collection.7.2 You agree to indemnify and hold the Company harmless from any claims, damages, or liabilities arising from the use of our service.
8. Dispute Resolution and Governing Law 8.1 Disputes/Binding Arbitration. Any dispute or claim arising from or relating to this Agreement or Curbside Trashcan Service LLC is subject to the binding arbitration, governing law, disclaimer of warranties, limitation of liability, and all other terms in the Curbside Trashcan Service LLC Conditions of Use. 8.2 By using Curbside Trashcan Service LLC, you agree to be bound by those terms.
9. Customer Satisfaction Our goal is your complete satisfaction. If you have concerns about the service, please notify us within 7 days so we can address the issue promptly.
